§ 150.068. RESPONSIBILITY FOR INFESTATION CONTROL.

  • (A) Owner. The owner of any structure shall be responsible for pest remediation within the structure.
    (B) Single occupant. The occupant of a one-family dwelling shall be responsible for pest remediation on the dwelling.
    (C) Multiple occupancy. The owner of a structure containing two or more dwelling units, a multiple occupancy, or a rooming house shall be responsible for pest remediation in the all areas of the structure and exterior property. If infestation is caused by failure of the occupant to prevent such infestation in the area occupied, the occupant and the owner shall be responsible for pest remediation consistent with NH HB 482 (2013).
    (D) Occupant. The occupant of any structure shall be responsible for the continued rodent and pest-free condition of the structure. Consistent with the guidelines set forth by a NH licensed commercial pesticide applicator.
    (E) Exception. Where the infestations are caused by defects in the structure, the owner shall be responsible for pest remediation.
